Booking Terms & Conditions
- CONTRACT
The following terms and conditions set out the Contract between Raymond and Patricia Haylock who shall be referred to as ‘we’, ‘us’, ‘our’ or the ‘Owner’ and ‘you’ the booker being the person who makes the booking on behalf of yourself and any other persons accompanying you ‘Guests’ for the holiday rental of Woodpecker Cottage ‘the Property’.
The Contract to occupy the Property is made on the basis that the Property is to be occupied by Guests for a holiday (as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 or similar legislation in any other jurisdiction)
You acknowledge on behalf of all the Guests that in making the booking the tenancy granted by these terms and conditions is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
- BOOKINGS AND PAYMENT
Bookings cannot be accepted from persons under 18 years of age.
Group bookings cannot be accepted for the use of the Property for stag or hen dos.
No bookings are valid until confirmed by us in writing (which shall include email).
Once we have confirmed your booking it cannot be changed unless agreed by us. In the event that we do agree to a change you will be required to pay an administration fee of £40.
If a booking is made more than 8 weeks before the holiday date you will be required to pay a deposit ‘Deposit’ equal to one third of the total holiday accommodation cost. The balance will be due not later than 8 weeks before the holiday is due to start.
The Deposit is non-refundable unless we are unable to accept the booking or the Property is unavailable at the time of the holiday (see below – Events beyond our control).
No refund can be made in respect of balance payments where notice of cancellation is given less than 8 weeks of the holiday arrival date.
If you make a booking within 8 weeks of the start of the holiday you will be required to pay for the holiday in full at the time of booking.
We strongly recommend that you take our holiday insurance (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to your stay.
Where any payment due is more than 7 days’ late we reserve the right to cancel your booking and re-let the Property. In these circumstances you will not be entitled to any refund.
- EVENTS BEYOND OUR CONTROL
In the event that the Property becomes unavailable to you due to events beyond our control we will refund all monies you have paid to us. However, we will not be liable to pay any compensation or expenses as a consequence of such an event.
- CANCELLATION BY YOU [1]
Where a cancellation takes place more than 8 weeks before the holiday date any payment less the Deposit will be returned. If a cancellation is made within 8 weeks of the holiday date no refund will be due unless we are able to re-let the Property (see below).
If we are able to re-let the Property for the period covered by the cancelled booking provided that it is re-let at the price originally paid by you we will refund any monies paid by you less the Deposit. If we are able to re-let the Property but the price we receive is less than the price paid by you we will refund your monies less the Deposit and the difference in price.
- YOUR RESPONSIBILITIES
You will ensure that all Guests:
- act responsibly and safely whilst at the Property;
- read the Property information provided and follow the instructions in relation to use of the Property including (without limitation) the use of the garden and grounds, the use of equipment, disposal of refuse, and noise;
- leave the Property and all things in or at it, in the same state of repair and cleanliness as at the start of your holiday;
- report to us any damage or breakages which occur during your stay and pay for said damage (wear and tear excepted);
- do not smoke at the Property;
- do not allow more than the stated maximum number of people or pets to stay at the Property;
- supervise children at all times whilst at the Property or within the grounds of the Property;
- allow us access to the Property if reasonably required;

- OUR RESPONSIBILITIES
We will ensure that:
- the Property is cleaned and ready for you by the stated arrival time;
- suitable arrangements are made for you to access the Property;
- we can be easily contacted (at reasonable times) should you have any questions or concerns during your stay;
- the Property will comply with all applicable laws and regulations (including health and safety regulations);
- adequate liability insurance is in place in respect of your stay;
- DOGS
We are happy to welcome one well-behaved medium sized dog for which we make an additional charge of £20. Young dogs (puppies of less than 6 months) must be notified and specifically authorised by us.
During your stay you must ensure that:
- your dog is not left alone at the Property and is kept under control at all times;
- any fouling is cleared up immediately and disposed of as instructed;
- your dog does not lie on the beds or other furnishings;
- you provide suitable bedding and feeding dishes for your dog;
- the dog is free from fleas and other parasites (failure to do so may incur additional charges);
- you notify us of any damage caused by your dog immediately. You will be liable for the cost of any damage or additional cleaning which may be required.
Failure to comply with the above may result in us cancelling the booking and asking you to leave the Property before the end of your holiday period without compensation.
- DESCRIPTION OF PROPERTY, FACILITIES AND EQUIPMENT
We aim to describe the Property, its equipment and facilities as accurately as possible but we reserve the right to make changes to the décor and furnishings from time to time if we deem necessary.
Should you or any of the other Guests for whom you are making the booking have any specific health or mobility difficulties or other requirements please speak to us prior to making the booking in order that the suitability of the Property can be established prior to booking.
- LIMITATION OF LIABILITY
We accept no liability for any accident, damage, cost, loss, injury, death, expense or inconvenience (whether to person or property) which you or any Guests or any other person you may invite to the property suffer or incur arising out of your booking or occupancy of the Property or which is any way connected with the same.
Nothing in these terms and conditions will limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees, agents, subcontractors; or for fraud or fraudulent misrepresentation.
- COMPLAINTS
If you have any complaint concerning the Property please notify us as soon as possible and we will do our best to resolve the matter. It is important to raise the matter whilst you are still at the Property.
- GOVERNING LAW
Any dispute, claim or other matter which may arise in relation to your booking will be governed by English law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales.
CORONAVIRUS (Covid-19):

Before you arrive:
If you or any other member of your party develop or have any symptoms of Covid 19 within 14 days of your holiday or receive a test and trace alert you must inform us immediately and follow all government instructions regarding self-isolation.
Where your booking is cancelled due to the above we will endeavour to re-let the Property for the period covered by your booking and the provisions set out in paragraph 4 of our Terms and Conditions shall apply.
Whilst staying at the Property
If you or any other Guest develop or have any symptoms of Covid 19 whilst staying at the Property you must advise us and return home immediately. If for any reason you are unable to return home you must advise us and you will be responsible for all costs incurred by us, including, but not limited to the rental costs for the period of your prolonged stay and the cost of re-allocating or reimbursing incoming guests.
Government Lockdown
Should the government declare a lockdown covering the period booked for your holiday you may choose whether to transfer your booking to another date (subject to availability) or to receive a refund for all monies already paid by you to us.
